CWC held on 19-7-2026 decides to file SLP in Hon'ble Supreme Court

RESOLUTION

As notified, virtual CWC was held under the presidentship of Com D Gopalakrishnan, CHQ President today (18/7/26).

46 CWC members attended. 4 members expressed their inability to attend because of personal reasons. .... members expressed their opinion that the association has no other option but to file SLP in Hon supreme court against Hon Delhi high court judgement delivered on 1/7/2026 setting aside Hon PB CAT judgement. The only exception was the voice of Com K Muthiyalu who expressed his opinion against filing SLP and said that Delhi HC judgement is correct.

With his lone dissent voice 

The Central Working Committee of AIBSNLPWA, which met virtually today resolved to challenge the judgment of the Hon’ble Delhi High Court in the BSNL Pension Revision case by filing a Special Leave Petition (SLP) before the Hon’ble Supreme Court of India.

The CWC resolved to engage the best available Senior Counsel/Advocate to effectively present the case and protect the legitimate demand of pension revision to BSNL and MTNL absorbed pensioners. At present there is no need to seek donation and the expenses shall be met from the available legal fund.

The CWC noted that this decision is in conformity with the resolution of the Ernakulam All India Conference to pursue the pension revision issue to its logical conclusion. The CWC authorised CHQ to take all necessary steps in this regard

The CWC appeals to all members to remain united and extend their full cooperation and support to CHQ. All are requested to take this decision to the grassroot members and the leaders have to adhere to the organisational discipline  and tell the CWC decision only.

சொசைட்டி பிரச்சனை யில், டெல்லி உயர் மட்ட அளவில், 13.03.2026 அன்று, நமது பொது செயலரிடம், சென்னை சொசைட்டி board க்கும் முழு அதிகாரம் உள்ளது, மத்திய அரசுக்கு, எந்த  நிதி அளவில் எந்த பங்கும் கிடையாது என்று கூறியுள்ளார். அதனை பின்பற்றி,மாநில தலைவர்&மாநில செயலாளர் இருவரும் 10.06.2026 அன்று சொசைட்டியின்  தலைவராக நியமிக்கப்பட்டுள்ள திருமதி. செல்வி அவர்களை சந்தித்து,நிலைமையை விளக்கினோம்.RGB MEMBER அனைவரும், BOARD OF டைரக்டர்ஸ் இருவரும் கலந்து முடிவெடுத்து, சொசைட்டி செயலாளர் இணைந்து, தீர்மானங்கள் போட்டு CRCS அலுவலகட்டிற்கு, தனி அதிகாரி கோரி கடிதம் எழுதுமாறு பேசினோம். அதற்குரிய செயல்பாடுகள், செய்வதற்கு வேண்டிய ஏற்பாடு களை அவர் செய்து வருகிறார் என்பதும் நமக்கு தெரிய வந்துள்ளது .        மீண்டும். 06.07.2026 அன்று மாநில தலைவர், மாநில செயலாளர் மற்றும் COM. D. விக்டர்ராஜ் ACS மூவரும் SRI. வீரமணி செயலாளர், GTECS சென்னை அவர்களை சந்தித்து,மேலே சொன்ன நமது கருத்துக்களை வலியுறுத்தினோம். நமது உறுப்பினர்களுக்கு தரவேண்டிய நிலுவை தொகையை    liabilily யில் கொண்டு வர வேண்டும். போர்டு மீட்டிங் கூட்டி, தீர்மானம் போட்டு அதை டெல்லிக்கு அனுப்பும்படி கூறினோம். சொத்தை விற்றால் தான் பணம் கிடைக்கும். அதற்காக அதிகாரி ஒருவரை கேட்டு எழுதி பெறுவதற்கு முயற்சிப்பதாகவும் கூறியுள்ளார். அதி விரைவில் இந்த பிரச்சனை யை தீர்க்க வேண்டும் என்று வலியுறுத்தி உள்ளோம்..

10-07-2026 வெள்ளி அன்று சேலத்தில் நடைபெற்ற அதாலத் கூட்ட நிகழ்வுகள்.  அதாலத் கூட்டம் சிறப்பாக நடைபெற்றது. சேலம் கிழக்கு மாவட்டச் சங்கத்தின் சார்பில் தோழர்கள் S. சின்னசாமி DS, V. பட்டாபிராமன் ACS, P. ராஜா DT, K. அய்யாக்கண்ணு DVP ,K. பழனி , துரைசாமி DVP, T. நாகராஜன் DVP, C. காளியப்பன் DOS மற்றும் தோழர் P. வேணுகோபால் AGS. Delhi High Court Pronounces Judgment in BSNL Pension Revision Case

The operative part of the Delhi High Court judgment is contained in paragraphs 269 to 273. It reads in substance as follows: 

269. Rule 37A of the CCS (Pension) Rules provides a special statutory framework for DoT employees permanently absorbed in BSNL/MTNL. On absorption, they cease to be Government employees, come under the IDA pay pattern, and are governed by the rules applicable to the PSU. Therefore, they cannot claim the benefits of the Central Pay Commission recommendations.

270–272. The Court held that Rule 37A only assures the same formula for calculation of pension at the time of retirement, and does not confer any continuing right to claim future pension revisions under the 7th CPC. Neither Rule 37A nor the Office Memoranda relied upon by the respondents entitle combined service pensioners under the IDA regime to pension revision under the 7th CPC. Since the 3rd PRC has not been implemented, the question of consequential pension revision also does not arise.

273. For all the aforesaid reasons, the impugned order dated 20.09.2023 passed by the Central Administrative Tribunal is set aside. Accordingly, this batch of writ petitions stands allowed.

Hon Delhi HC has set aside the PB, CAT judgement dated 20/09/2023 and allowed the writ petition filed by DoT.
